Probate is the process that is followed following the death of a person and it confirms that the Will is the most recent and valid Will of the deceased person. It provides authority to the person identified in the Will as the Executor or Executrix to administer the deceased person’s estate.
The probate process involves the Executor or Executrix applying to the Supreme Court of Victoria for what is called a Grant of Probate. That process usually involves providing the deceased person’s Will, details the assets and liabilities of the deceased person and a range of other details concerning the deceased person. Once the Grant of probate is issued the Executor or Executrix can begin the process of administering the estate.
Whilst the probate process has a clearly defined series of steps there may be circumstances whereby the Supreme Court requires clarification of certain matters, and that may require the submission of an affidavit clarifying matters for the Court.
